Terms & Conditions

  1. Introduction
    These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Participant" or "you") and NFA Soccer ("we," "us," or "our"). By accessing our website or participating in any NFA Soccer programs, events, or activities, you agree to be bound by these Terms. If the Participant is a minor (under 18 years of age), a parent or legal guardian must agree to these Terms on their behalf.

  2. Program Participation
    2.1 Code of Conduct
    Participants agree to:

  • Adhere to all rules, guidelines, and instructions provided by NFA Soccer staff and coaches.

  • Exhibit respectful behavior toward coaches, teammates, staff, officials, and other participants.

  • Refrain from engaging in bullying, harassment, discrimination, or any form of misconduct.

  • Comply with the designated dress code and wear appropriate attire for activities.

2.2 Disciplinary Actions
Failure to comply with the Code of Conduct may result in disciplinary actions, including but not limited to warnings, suspension, or immediate dismissal from the program without refund. All decisions regarding disciplinary actions are final.

  1. Payment and Fees
    3.1 Payment Terms: All fees for programs, sessions, and events must be paid in full prior to participation unless otherwise arranged in writing.
    3.2 Non-Refundable Payments: Payments are non-refundable unless specified in our Cancellation Policy.
    3.3 Additional Costs: Participants are responsible for any additional costs such as equipment, uniforms, and travel expenses.
    3.4 Late Payments: Late payments may incur additional fees. We reserve the right to suspend participation until all fees are paid.

  2. Cancellation Policy
    4.1 Sessions and Activities

  • Advance Notice: Cancellations for Weekly Labs or any other sessions must be made at least 24 hours prior to the scheduled activity to qualify for a refund or credit.

  • Procedure: To cancel, notify us via email at info@NFA-FK.com.

  • Forfeiture: Failure to provide the required notice will result in forfeiture of session fees.

4.2 Memberships

  • No Refunds: No refunds are available for memberships.

  • Termination: Participants may cancel their membership by providing a 30-day written notice. Access to membership benefits will continue until the end of the current billing cycle.

  1. Media Consent
    By participating in NFA Soccer programs, you grant us the right to use photographs, videos, and other media that may include your likeness for promotional, educational, and other business purposes across various platforms, including our website and social media.
    Opt-Out: If you wish to opt out of this media consent, please notify us in writing at info@NFA-FK.com prior to your first session.
    Revocation: You may revoke your consent at any time by providing written notice. Please note that revocation is not retroactive.

  2. Assumption of Risk
    Participation in athletic activities involves inherent risks, including but not limited to physical injury, illness, and property damage.

  • Acknowledgment: You acknowledge and understand the risks associated with soccer and related activities.

  • Voluntary Participation: You voluntarily choose to participate and assume all such risks.

  • Safety Measures: We implement safety protocols to minimize risks but cannot eliminate them entirely.

  1. Waiver and Release of Liability
    You hereby release, waive, discharge, and hold harmless NFA Soccer, its directors, officers, employees, coaches, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained while participating in our programs, whether caused by negligence or otherwise.
    Scope: This waiver extends to all claims of every kind or nature, known or unknown, foreseen or unforeseen.

  2. Indemnification
    You agree to indemnify and hold harmless NFA Soccer from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising out of or related to your participation in our programs or any violation of these Terms.

  3. Medical Authorization

  • Consent to Treatment: In the event of an injury or medical emergency, you authorize NFA Soccer to seek medical treatment on your behalf.

  • Financial Responsibility: You assume full responsibility for any medical expenses incurred as a result of participation.

  • Insurance: We encourage all participants to have personal health insurance coverage.

  1. Concussion Policy
    We adhere to state guidelines and prioritize the health and safety of our athletes concerning head injuries.

  • Immediate Removal: Any player suspected of sustaining a concussion will be immediately removed from play and will not return the same day.

  • Medical Evaluation: The player must be evaluated by a licensed healthcare provider experienced in concussion management. Written clearance is required before returning.

  • Gradual Return to Play: Players will follow a stepwise return-to-play protocol as recommended by the healthcare provider.

  • Parent/Guardian Notification: Parents or legal guardians will be notified immediately if a concussion is suspected.

  • Training: Coaches receive annual concussion recognition education as required by law.

  1. Player Conduct and Removal Policy

  • Zero-Tolerance: We maintain a zero-tolerance policy for bullying, harassment, discrimination, and other forms of misconduct.

  • Immediate Dismissal: Serious misconduct may result in immediate dismissal from the program without refund.

  • Parental Notification: In cases involving minors, parents or legal guardians will be notified of any disciplinary actions.

  • Appeals: Decisions regarding dismissal are final and not subject to appeal.

  1. Modification of Services

  • Right to Modify: We reserve the right to modify or discontinue any program, event, or service with reasonable notice.

  • Changes: This includes changes to schedules, locations, content, and instructors.

  • Notification: Participants will be notified of significant changes via email or through our website.

  • Refunds: In the event of significant changes, alternative arrangements or refunds may be offered at our discretion.

  1. Termination Rights

  • Program Cancellation: We reserve the right to cancel or reschedule programs due to low enrollment, facility issues, or other unforeseen circumstances.

  • Notice: Participants will receive prompt notification of cancellations.

  • Refund Policy: If we cancel a program, participants may receive a refund or credit towards future programs.

  1. Amendments
    We may amend or modify these Terms at any time.

  • Notice of Changes: Participants will be notified of any significant changes via email or through our website at least 15 days prior to the changes taking effect.

  • Acceptance of Amendments: Continued participation after such notification constitutes acceptance of the modified Terms.

  1. Governing Law and Jurisdiction
    These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

  • Dispute Resolution: Any disputes arising out of or relating to these Terms shall be resolved in the state or federal courts located within Colorado.

  • Attorney’s Fees: In the event of a dispute, the prevailing party is entitled to recover reasonable attorney's fees and costs.

  1. Severability
    If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

  2. Entire Agreement
    These Terms constitute the entire agreement between you and NFA Soccer regarding participation in our programs and supersede any prior agreements or understandings.

  3. Force Majeure
    We shall not be liable for any failure to perform our obligations due to events beyond our reasonable control, including but not limited to natural disasters, war, pandemics, or government regulations.

  4. Age Requirements and Legal Guardians

  • Minors: Participants under the age of 18 must have a parent or legal guardian agree to these Terms on their behalf.

  • Responsibility: By registering a minor, the parent or legal guardian consents to all Terms and assumes responsibility for the minor's compliance.

  1. Privacy Policy
    Our Privacy Policy outlines how we collect, use, and protect personal information. We comply with all applicable privacy laws, including the Colorado Privacy Act.

  2. COVID-19 and Health Policies

  • Acknowledgment of Risks: You acknowledge the contagious nature of COVID-19 and voluntarily assume the risk of exposure.

  • Compliance: Participants agree to adhere to all health and safety protocols recommended by health authorities and implemented by NFA Soccer.

  • Liability Waiver: You release NFA Soccer from any claims related to COVID-19 exposure.

  1. Insurance

  • Organization's Insurance: We carry general liability insurance as required, but this does not replace the need for personal health insurance.

  • Participant Responsibility: Participants are responsible for their own medical and accident insurance coverage.
